Freelancing while employed in India

Taking on freelance work alongside a salaried job is common, and in most cases lawful. Whether it is safe for you specifically depends almost entirely on one document you have already signed — and on a few habits that are easy to get right and expensive to get wrong.

There is no general law in India that stops a salaried employee doing paid work for someone else. The question is almost never "is this legal" in the abstract. It is "does my employment contract allow it", and that is a private matter between you and your employer.

Some employers explicitly permit outside work with disclosure. Some prohibit it outright. Many say nothing clear at all, which is the hardest case, because silence is not permission — it usually means the answer lives in broader clauses about conflict of interest and company time.

Breaching those terms is not usually a criminal matter. It is a contractual one — which in practice means the risk is to your job, your notice period and your reference, not to your liberty. That is precisely why it is worth getting right.

What to look for in your contract

Read the whole thing, but these are the clauses that decide it. The wording matters more than the heading.

  • Exclusivity or full-time-and-attention. Language requiring you to devote your whole professional time to the employer. This is the clause that most often rules out outside work, and it is common in Indian employment agreements.
  • Conflict of interest. Usually broader than people expect. Working for a competitor is the obvious case; working for your employer’s client or supplier often counts too.
  • Intellectual property assignment. Check whether it covers everything you create during your employment, or only work created for the employer, using their resources, or within their field. A broad clause can capture work you did on a Sunday on your own laptop.
  • Disclosure obligations. Some contracts permit outside work only with written consent. If so, ask. A written approval is worth far more than an assumption.
  • Non-compete and non-solicit. Post-employment non-competes are generally hard to enforce in India, but restrictions that apply while you are still employed are a different matter.

Most people who get into trouble do not get caught doing freelance work. They get caught doing it carelessly.

The practical rules that keep you safe

These habits cost nothing and remove almost all of the risk.

  1. 1Never use your employer’s equipment, accounts, software licences or network for client work. This is the single most common way outside work becomes provable — and the fastest way an IP clause starts to bite.
  2. 2Never work on it during your working hours. Not lunch on a company laptop, not a quick call from a meeting room.
  3. 3Do not take on work for your employer’s competitors, clients or suppliers, even where the contract does not name them.
  4. 4Use a personal email address and a personal device for everything, from the first enquiry onward.
  5. 5Do not use your employer’s name, logo or client list to sell yourself. Describing your skills is fine; trading on their brand is not.
  6. 6Keep your own records — briefs, invoices, and what you delivered. You will want them for tax, and you would want them in a dispute.

Tax: what changes when you earn outside salary

Once you earn money outside your salary, your tax position changes in ways your employer’s payroll will not handle for you. This is the part people most often leave until it is a problem.

  • Freelance income is taxable and must be declared, even where the amounts are small and even where no tax was deducted at source.
  • Your employer deducts tax on your salary only. Nothing is withheld against your freelance earnings by default, so the liability accumulates until you settle it.
  • Clients may deduct tax at source on professional fees before paying you. That deduction is creditable against what you owe — but only if you can evidence it, so keep the certificates.
  • The income-tax return form appropriate to salary alone is often not the right one once you have business or professional income. Filing on the wrong form is a common and avoidable mistake.
  • There is a turnover threshold above which GST registration becomes mandatory for services, and simplified presumptive schemes exist for some professionals. Both have conditions and both change — get the current position from a CA rather than from a blog.
  • Advance tax may become payable during the year rather than in one settlement at the end.

The failure mode is not legal. It is taking on more than a weekend can hold, delivering late, and damaging a reputation you were trying to build.

  • Take one project at a time until you know honestly how long your work takes outside office hours.
  • Quote a delivery date that assumes a bad week, not a good one. You are working around a job that has first claim on your time.
  • Be straightforward with the client about your availability. "Evenings and weekends, replies within a day" sets expectations better than implied full-time attention.
  • Pick work adjacent to what you already do well. Your first outside project is not the moment to learn a new skill on someone else’s deadline.

Can I freelance while working full time in India?
